内容はインスタグラム写真を使われてポルノ画像を作られてしまったという話です。調べてみると友人、知人に LoRAされた AIポルノを生成されたという被害はそこそこ稀にあるトラブルのようです。今回炎上しているのは警察対応してくれないということについてです。以下翻訳

日米の法律の違い

AI画像生成自体は罪になりません。上記のやりとりではインスタグラム写真勝手学習に使われたということで、著作権侵害として対処しようとしています

  

ただし日米で法律が異なるのに注意です。

日本ではどうでしょうね?

日本ではよく知られたように著作物AI使用は広く認められています。ただし

  

第三十条の四 

著作物は、次に掲げる場合その他の当該著作物表現された思想又は感情を自ら享受し又は他人享受させることを目的としない場合には、その必要と認められる限度において、いずれの方法によるかを問わず、利用することができる。ただし、当該著作物の種類及び用途並びに当該利用の態様に照らし著作権者の利益を不当に害することとなる場合は、この限りでない。

 

とあります。『著作権者の利益を不当に害することとなる場合』に該当すると良いのですが。そうじゃないと困る。

また、プライバシー侵害という観点から見れば「宴のあと事件」「石に泳ぐ魚事件」などの判例をみるに民事で訴えることは可能なように思えますね。

さらにいえば、もともと日本ではポルノの扱いが厳しくてポルノ画像公共の場送信するのは禁止されています猥褻物頒布罪)

なので上で話題になっている男は日本なら刑事罰で捕まるはずです。

 

こんなわけで、アメリカで起こっている問題がそのまま日本ですぐさま問題になるわけではありません。

日本における表現規制の厳しさに救われたようなちょっと不思議な状況ですね

 

萌え絵女性を救う?

あくまで現状においてですが、LoRAによるAIポルノ被害日本では全然耳にしません。

  

だって日本人萌え絵を生成させているんですもの

  

アメリカ人はフォトリアルポルノを作るのに対し、日本人萌え絵を作る。

萌え絵のおかげで日本人女性はあまり被害に遭わないというちょっと不思議なおはなし。 

  

もちろんこれはあくまで傾向です。例外はありますよ。アメリカ人にも萌え絵を生成する萌えオタはいます。また、古くはグラビアアイドルコラ画像を作る日本人もいました。

ここで重要なのは数の問題です。

昔はコラ画像を作る技術を持った人たちはごく一握りだったのに対し、技術を持たないアホが画像生成AIを手にしてしまったということが数々の問題引き起こしています

アメリカでは大量のアホがフォトリアルエロ画像を生成しているせいで出てくる問題なわけです  

逆に言い換えれば、日本にも知人でLoRAする知人の写真で追加学習させるアホが探せばいるかもしれないけれど数が少なすぎて表面化しないということですね

 

最後

念のためAI画像生成絵師さん達の名誉のために書いておきますが、Pixiv等でルールを守って投稿されている方々は何のトラブルも起こしていません。生成している絵もこだわりが込められていて、使う道具が違うだけで愛があるのだと感じます。まともな人ほど静かで目に入らない、問題のあるやつほど悪目立ちするというのが話がこじれる原因ですね

  

一連の記事絵師AI絵師対立を煽るものではないことを強調しておきます。(いちおう私は絵師立場です)

5年前の今日婚姻届を出したあと行ったホテルディナーの写真おすすめアルバムとして出てきた、妻の写真を見るとめちゃくちゃ笑顔が弾けてて可愛すぎる。

今も変わらず弾ける笑顔で一緒にゲームしたり映画みたりテレビ見たりして毎日幸せに過ごせてる。

仕事がしんどくても、嫌なことがあっても帰って抱きしめてもらって一緒にご飯食べたり笑ったりしたらまた朝頑張れる。

onedriveが原因でデスクトップデータが消えた

いや、お前データを守る側ちゃうんか。

なんでお前に大事データ消されなきゃならんのよ。

調べてみたらひどいクソ仕様だったので、同じ轍ふまないように知見共有します。

なお、消えてしまったデータは息子の卒業式動画データ復元不能

ダメージでかすぎで立ち直れないかもしれない。

リテラシーの話にしたくないので、一応くわしい状況を説明

興味ない人は読み飛ばしOK

ストレージは壊れるものという前提は理解しているつもりなので、状況ごとにいくつかのバックアップ体制は取ってある。

なのでデスクトップ基本的一時的データしか置かない。

そのため、今回の被害は本当に息子の卒業式動画データだけ。

安くなったとは言えすべてのストレージSSD化するには至っていない。

そのため、OSソフトウェアなんかはSSDインストール写真動画などのサイズがでかいデータRaid HDDミラーリングして格納するようにしている。

それ以外にもそれほどサイズの大きくないデータonedriveとかのクラウドストレージを利用。そのデータRaid HDDミラーリングして二重にバックアップ体制を敷いている。

趣味写真をやっているのだが、今回の事故はその編集フローの中で起こった。

編集と格納は別で考えているので、アクセス速度が高いほうがいい編集SSD上で行い、格納はRaid HDDに行っている。

そのタイミングgoogle photo分散バックアップ必要に応じて家族なんかと共有を行う。

まり撮影が終わったら最初にすることは、SSD上にあるデスクトップの一時フォルダ写真動画データコピーすることから始まる。

Raid HDDに格納するのは、編集ソフトレタッチが終わってからだ。

まずは写真データから編集を行い、RAWデータから無事にjpegデータへと書き出してHDDへの格納が終わった。

そのタイミングで妻からの頼まれごとのためにメールpdfプリントして名前をつけて保存しようとした。

めったに使わない機能なのだが、指定されたのはonedriveフォルダだったので、そのまま保存をクリック

ところが、PCからonedriveフォルダアクセスしても出力したpdfデータが見つからない。

おかしいなと思ってもう一度出力を試みて保存フォルダパス確認してみる。

すると、今現在HDD側に指定してあるonedriveパスが、SSD上のデフォルトパス指定されているようだった。

ここで思い至ったのが、確かPConedriveを設定した際にうっかりデフォルト設定のまま起動してしまい、その後、HDD上にパスを切り替えたという状況だった。

「そうかぁ。保存先を変更すると元のファイルを移動させるんじゃなくてコピーを作ってしまうんだな」なんて感じに妙に納得しつつ、もう一度しっかりとパス確認した上でpdfコピーしてからSSD上のonedriveshift deleteで削除した。

エクスプローラーを閉じてデスクトップに戻ってくると妙な違和感

ない。

デスクトップ上のファイルが見事にない。

はぁ?と思ってPCダブルクリックすると、すぐに警告ウィンドウが開いて「デスクトップへのパスが間違っています」といったエラー表示。

焦る。かなり焦る。

ゴミ箱を開いても当然データは残っていない。

ウィンドウをすべて閉じても、デスクトップ上にはデフォルトアイコンけが並んでいるだけ。

頭真っ白。

多少大事データはあったかなと思いながらも致命的と言えるものは思いつかず(まだ見落としてるだけかもしれない)、しかし、すぐに一時フォルダごと動画データがないことに気づく。

写真はすでにjpg出力してあるので、RAWデータが消えてしまったのはなんとかなる。

子供卒業式動画はまだ変換をかけてもないし、当然アップロードもしていない。

終わった。

まりにもショックだ。

読み飛ばしここまで。

結局何が原因だったかというと、最初onedriveセットアップする際に、デフォルトの保存先、なおかつデスクトップやマイドキュメントなんかもバックアップに含めるという設定で始めてしまたからだったらしい。

この、onedriveバックアップデスクトップを含めるという操作をすると次のようなことが起こる。

本来はC:\Users\ユーザー名\Desktopにあるはずのデスクトップデータが、C:\Users\ユーザー名\onedrive\Desktopに変更される」

ここからの手順は順序が曖昧なのだが、次の操作を行っている。

onedriveバックアップからデスクトップを含めないように設定変更

onedriveバックアップ先をSSDからHDDに変更

この2つの動作を行ったにも関わらず、何故かこのパソコンデスクトップは、C:\Users\ユーザー名\onedrive\Desktoに残ったままになってしまったというわけだ。

そのため、C:\Users\ユーザー名\Desktopデスクトップがあると思いこんでいた自分は、C:\Users\ユーザー名\onedriveにあるonedriveフォルダを、疑うことなく削除することができた。

そしてその結果、デスクトップにおいてあったデータのすべてを失った。

いや、流石にこんなクソ設定想定できないでしょ。

大事データを守るっていう名目があれば、大事データの格納先をそんな簡単に変えていいと思ってる?

それ、誰に許可取ってやってるんだよっていうさ。

その辺の共通プロトコルを、バックアップソフトが、しかOS提供元がやっていいのかよっていう。

これはちょっと言わせてくれ。

マイクロソフトクソだわ。

まぁ、なんというか皆さんも気をつけてください。というか、こんなの気をつけようがないけどな。

どこに気持ちをぶつけたって息子の大事な思い出は帰ってこないのはわかってるけど、やるせなさくらい吐き出させて。


追記

説明が複雑でちゃんと伝わってなかった部分の補足。

ブラウザonedriveゴミ箱データが残っている可能性はゼロです。

その理由は以下の通り。

このパソコンは1ヶ月ほど前に新規セットアップしたものでした。

そのセットアップ過程で、onedriveインストールする際にデフォルトの保存先、なおかつデスクトップバックアップという設定にしてしまいました。

ここでノールックで設定してしまった自分が一番悪いことは認めます

onedriveセットアップが終わったあと、同期に時間がかかっていておかしいな?と思ってファイルアップロード履歴確認したところ、あらかじめ古いパソコンからコピーしてあったデスクトップデータアップロードしようとしていたので、慌てて設定を見直して、デスクトップ同期のオフ、保存先をHDDに変更しました。(変更した順番は書いてある通り覚えていません。順番が逆だったら起こり得なかったかも)

この操作によって、onedriveの保存先はHDDに変更になり、デスクトップの同期も停止しました。

しかしそうした操作を行ったにも関わらず、デスクトップの保存先はC:\Users\ユーザー名\Desktopに戻ることはなく、C:\Users\ユーザー名\onedrive\Desktopのままになってしまっていました。

そのことに気づかずに1ヶ月以上作業を続けていたなかで、記載の通りSSD内に同期されていないonedriveフォルダ発見したので削除した結果、デスクトップデータ消失しまったという話です。

そして卒業式動画データデスクトップコピーしたのは、onedriveの同期を切ったずっとあとのことです。

もともとonedriveバックアップするつもりもないし、バックアップされていないのでwebに残っているはずもないのです。

デスクトップデータがそんなところに格納されていることがわかっていれば、もともと削除なんてしません。

同期されていないすでに使われていないonedriveデータだけしか削除するつもりではなかったのに、何故かその中に現在進行系で使っているデスクトップデータが格納されていて、一緒に削除されてしまったというお話です。

ちなみに、削除直後は本当に何が起こったのか意味がわかりませんでした。

その後にマイコンピューターを開いた際、別ウィンドウエラーが出たことで初めて状況が理解できたということです。

そのエラーが「デスクトップC:\Users\ユーザー名\onedrive\Desktopアクセスできません」といった内容のエラーです。

デスクトップ?お前なんでそんなとこに保存されてたの?からの、そういえば思い出してみればこんなことあったよなーで、原因に思い至ったというわけです。

SDカード復元を試みましたが、サイズの大きい動画データですので、ヘッダーは読み込めたものの、データのものはすでに別の写真データに書き換えられてしまっていたせいかちゃんと開けませんでした。

SDカードからデスクトップデータを移すタイミングというのは、行事ごとに撮影が終わったらSDを空にして新しく撮影できる状況を作るためなので、基本的にはデスクトップコピーしたあとは次の撮影前に必ずフォーマットすることを習慣づけています

それは、毎回SDカード空っぽにすることで、現像ときデータの重複が起こらないようにするためです。(趣味写真を取っているので撮影枚数が莫大。尚且つ現像ソフト不要データを削除するので、SDを空にしないと、削除後にまたコピーしてしまったりと効率が悪いため)

撮影データデスクトップに一次保存→次回撮影時にSDカードフォーマット時間があるときPC上のデータを選別、現像バックアップ含めてデータを格納→SDカードから新しい撮影データPCコピー→次回撮影時にフォーマット時間あるときPC上のデータを選別、現像・・・

SDカード自体も紛失の危険性とか考えてそれほど信用しているメディアではないので、できるだけデータが保管されている時間を短くするようにしています

個人的には、このワークフローが一番データの保存性も高く、無駄も少ない処理方法だと思っています

だってデスクトップを間違って消すなんてこと普通しないでしょ。

壊れたなら仕方ないって、それはそれで納得できるんだって

流石にこんなことまで想定したワークフロー作れってのは無理な話ですよ。

その証拠に、これまでこの方法10年以上無事故でしたから。

すでにonedriveからデスクトップの同期も切ってて、しかも別フォルダonedriveちゃんと稼働してるのに、まさか自分デスクトップがC:\Users\ユーザー名\onedrive\Desktopに保存されてるなんて思う?

草津溫泉聞名的群馬草津町,昨日(6)地方町議罷免公投結果出爐,草津町有史以來第一位女性議員確定遭罷免

隨著這場已經為期一年地方議員攻防戰又再一次劃下一個逗點,草津溫泉曝光率大增。有不少網友表示再也不想去草津溫泉觀光,表明再也不去草津溫泉的hashtag #草津温泉には行かない 在 7號上午一度衝上日本推特流行趨勢,更有媒體形容現在草津溫泉根本就是「厭女之湯」。

到底草津溫泉這一年來發生了什麼事?

草津町議會史上第一位議員

2011年出身群馬桐生市新井祥子當選草津町議會的議員新井祥子是草津町議會有史以來首位女性議員,更連任過一次。

去年(2019)11月新井祥出版電子書籍,並在書中表示是自己曾在町長室裡和町長黑岩信忠發生性關係。新井祥子在 11月29日的記者會上表示,自己2015年1月8日前往町長室時遭到町長強暴。新井祥子說,今天她之所以會把這件事情寫在電子書裡,是因為草津町警察和媒體都在町長的掌握之下,所以她才選擇用這種方式將這件事情公諸於世,並強調自己所寫的內容都是真的,之後在法庭上一定能證明這些內容都真的。

這裡所說的法庭,指的是黑岩信忠町長新井祥子損害名譽的民事訴訟,目前訴訟還在進行中。

不信任案提案失敗,提案議員遭懲處

就在新井祥子召開記者會後過了幾天,新井祥子和另一名草町議中澤康治在 12月2日向黑岩信忠町長提出不信任案。但該不信任案只有提案的 2人贊成,其餘 9名議員都反對,該不信任案遭到否決。同一天,草津町議會以「傷害到議會的品格」為由,在只有 12人的草津町議會以超過 4分之3門檻的 10同意票,在 12月2日將新井祥子從議會中除名。至於和新井祥子一起向町長提出不信任案的中澤康治,則在 12月6日的町議會上遭到「陳謝處分」——中澤康治被迫要在議會上為自己說了「不符合事實」的發言道歉。

對於除名處份不服的新井祥子,向群馬知事山本一太申請審查。群馬縣先在 1210日做出假處分,要求草津町群馬縣審查結果出爐之前,必須要立刻恢復新井祥子的席次,否則會侵害新井祥子支持者的參政權。群馬縣接著在今年 8月群馬正式取消新井祥子的除名處分,讓新井祥恢復草津町議員身份。

政府才剛取消處份,町議會就發起連署

然而,這起事件並沒有因此結束。在群馬縣取消新井祥子的除名處分後,草津町議會議長黑岩卓連同其他町議員立刻組成要求新井祥子解職之會」,表明草津町議員不能接受群馬縣取消了新井祥子除名處分的決定,要求草津町民們一起來罷免新井祥子。罷免理由是,不能接受新井祥子在議會上說自己町長町長室發生肉體關係,這已經重創草津溫泉的品牌形象,不應該再繼續支付新井祥議員薪資。

這起罷免案在今年 9月初達到罷免門檻,以草津町議會議長黑岩卓為首的罷免案獲得超過選舉人名簿 3分之1以上的 3,180人連署。將在 12月6日正式舉行罷免公投。

罷免公投通過,新井祥子即刻遭解職

罷免投開票結果, 2,542票贊成、208票反對,贊成票超過有效票半數以上,新井祥子即刻遭解職。投票率 53.66%(投票權人共 5,283人)。

值得注意的是,罷免案的連署共有 3,317人連署(有效連署書只有 3,180份),但實際出來投票的人只有 2,750人。也就是說,有不少民眾有連署罷免,但卻沒有真的出來投票。這次罷免案的投票率雖然有 53.66%,但相較於去年 4月草津町議員選舉的投票率高達 69.49%,這次的投票率不算高。

根據草津町選舉管理委員會,12席的町議會在 11月26日時有一名議員過世,再加上這次新井祥子遭罷免,目前草津町議會只有 10議員缺 2席。如果又少 1席次的話,才會舉辦町議補選

訴諸情感缺乏理性判斷的罷免

面對這次的罷免案結果,新井祥子表示這樣由町議員主導的罷免公投是否真的反映民意感到質疑,不排除申請異議。新井祥子也提到,她認為像町長町議會這樣以自己地方勢力要求町民配合的公投案,才是重創草津町草津溫泉品牌的因素。

擅長地方自治論的高崎經濟大學岩崎忠也質疑,這次針對新井祥子的罷免案是以「品格」、「倫理」為訴求,認為新井祥子沒有續任町議員的「品格」。但有沒有符合町議員的「品格」這種事情很難用「贊成」和「反對」來判斷,到頭來這樣的公投只會陷入情感論,感情用事,而非理性的投票

男性為首的「村社會」

網路媒體《HARBOR BUSINESS》就指出,這次罷免案最大的問題在於,新井祥子和町長黑岩信忠的性侵案還在調查與訴訟進行階段,在這種情況下,由議會長主導公投罷免案,現在新井祥罷免掉了,萬一之後訴訟結果,真的認定町長黑岩信忠性侵新井祥子,該怎麼辦?

再者,地方公投這種事情是訴諸民意沒有錯,但官方應該要確保中立的立場,才能將民眾可以公正客觀的判斷。但這次的情況是,町議會在草津町大公空間都貼滿了「罷免新井議員!」的海報,相當於讓所有來到草津溫泉觀光的民眾,來到草津溫泉第一眼看到的不是「歡迎光臨草津溫泉」而是「恢復草津溫泉的驕傲與信賴,罷免新井議員!」,在公共空間只能看到官方強制推行的單一立場,沒有辦法看到另一派聲音,這樣就已經失去了公投的公平性

此外,面對新井祥子這樣說出自己被性侵經驗的受害者,町議會沒有保護當事人就算了,還這樣大大方方地在草津溫泉的公共空間裡貼滿了「罷免新井議員!」的海報,根本就是在和社會大眾說草津溫泉就是個「厭女之湯」。《HARBOR BUSINESS》總結到,這次一連串的事件就是以町為單位的霸凌事件,也讓大家再次看到鄉下地方封閉的「村社會」壓力與以男性為首的厭女風氣。

なんせレンズ物理的に前後させるのだからスマホよりも圧倒的な構図を実現できる。

100m先の子どもたちの表情を撮るのはスマホでは不可能

フルハイビジョンでも4Kでもファミリー向けビデオカメラの画質はクソい。

いや、普通に見るぶんにはいいのよ。

でも、デジイチミラーレス動画と比べると、CMOSサイズの影響で明らかに劣る。

デジイチニコンD3400のフルHD4KハンディカムソニーAX60を比べたら前者のが圧倒的に綺麗なのよ。(しかもD3400はエントリーモデルで、旧世代D5000あたりは中古で2万円程度。AX60は新品9万もする。)

しかし!デジイチ動画撮影時のオートフォーカスがクソで、フォーカスを外しまくるリスクがある。こうなるといいレンズにでかいCMOSでも無意味になる。

最新モデルでは改善されてるのかな?

なので、頑張って実現した高画質も共有段階では数段劣るものになる。

美しい高画質データ子供の成長後自分の老後に楽しむことになる。

近けりゃスマホ、遠けりゃ4Kビデオカメラバランスよし。

フォーカスをビシッとコントロールできる自信ある&LINEとかでの共有は帰ってパソコンで加工できるというニキならデジイチミラーレス

日本語でパ行の言葉が少ないのは何故なのだろう

赤ちゃん発音やす発音としてpの音が存在するのに、幼児語以外の日本語でパ行を用いる語句は少ない

罰符とか法被とか日本とか確かにパ行が使われた日本語はあるけれど、明らかに少ない

しりとりでパ行で渡されると苦労するのをイメージできる

何故だろうと思いぐぐって見ると、平安時代には「はひふへほ」は「ぱぴぷぺぽ」と発音されていたらしい

古代日本語にhの音は無かったとのこと

「母(はは)」は「パパ」と読んだということか!

母なのにパパとはこれいかに面白い

しかしそうなると次の疑問はp→hに音が変化するのは日本語以外でも発生するのかということ

どうやらこの変化は唇音退化と呼ぶらしい

wikipediaの唇音退化のページを見てみると英語……というかインドヨーロッパ語でも同様に発生しているみたいだ(←英語場合そのような変化の規則をグリム法則というらしい)

「SHEIN」については大量高速企画ゆえのデザイン盗用疑惑、小ロット高速生産ゆえの労働環境疑惑が指摘されているが、私は次の二点で容認すべきでないビジネスだと考える。

一つはH&Mなど従来のファストファッションなどとも共通する「使い捨て懸念であり、手早く安価に作られた「SHEIN」の商品が長く愛顧されてリユースされていくとは到底思えない。

性的にも感性的にも耐久性は期待できないから、短期に捨てられて大量の衣類ゴミとなっていく運命が見えている。それが地球環境の負荷となるのは言うまでもなく、アンチサステナブルとの誹りは免れない。

二つ目関税消費税負担しないアンフェアビジネスだということだ。

初期のアマゾンでも消費税法人税回避されているという指摘があったが、越境D2C(消費者直販)の「SHEIN」は日本国法人税はもちろん、関税消費税回避している。
