ニコニコ動画は、DMCA的なプロセスを取ると（主にひろゆきなどが）公言している点が凄い。確かにアメリカでは合法なプロセスだが、現行の日本ではぶっちぎりで違法なのだが。まあ、法改正に向かう動きも確かに存在するし、そういう状態だと当局の動きも鈍い、その辺まで法務は考慮しているのかもしれないが。道義的に考えても、言われたら消しているのは事実なわけで、いまいち文句を言いにくい。
こういう、筋は通っているが現行法と抵触する俺ルールを押し通す辺り、アプローチが2ch的だなぁ、とつくづく思う。「力技でも俺ルールに筋が通ってれば案外なんとかなるもんだ」という2chの成功体験を下敷きにしているのかも知れない。実際、法なんてものは実情に合わせて変わっていくべきものだと俺は思っているので、こういうアプローチは割と好き。ニコニコ動画は誰がなんと言おうと面白いので、アレが法的にダメだというのならば法の方が変わるべきだ。
Googleの中の人たちが日本でテレビ局と交渉した翌日の出来事。
