AI画像生成自体は罪になりません。上記のやりとりではインスタグラムの写真を勝手に学習に使われたということで、著作権侵害として対処しようとしています。
ただし日米で法律が異なるのに注意です。
日本ではよく知られたように著作物のAI使用は広く認められています。ただし
第三十条の四
著作物は、次に掲げる場合その他の当該著作物に表現された思想又は感情を自ら享受し又は他人に享受させることを目的としない場合には、その必要と認められる限度において、いずれの方法によるかを問わず、利用することができる。ただし、当該著作物の種類及び用途並びに当該利用の態様に照らし著作権者の利益を不当に害することとなる場合は、この限りでない。
とあります。『著作権者の利益を不当に害することとなる場合』に該当すると良いのですが。そうじゃないと困る。
また、プライバシーの侵害という観点から見れば「宴のあと事件」「石に泳ぐ魚事件」などの判例をみるに民事で訴えることは可能なように思えますね。
さらにいえば、もともと日本ではポルノの扱いが厳しくてポルノ画像を公共の場に送信するのは禁止されています(猥褻物頒布罪)
なので上で話題になっている男は日本なら刑事罰で捕まるはずです。
こんなわけで、アメリカで起こっている問題がそのまま日本ですぐさま問題になるわけではありません。
日本における表現規制の厳しさに救われたようなちょっと不思議な状況ですね
あくまで現状においてですが、LoRAによるAIポルノ被害は日本では全然耳にしません。
アメリカ人はフォトリアルなポルノを作るのに対し、日本人は萌え絵を作る。
萌え絵のおかげで日本人女性はあまり被害に遭わないというちょっと不思議なおはなし。
もちろんこれはあくまで傾向です。例外はありますよ。アメリカ人にも萌え絵を生成する萌えオタはいます。また、古くはグラビアアイドルでコラ画像を作る日本人もいました。
昔はコラ画像を作る技術を持った人たちはごく一握りだったのに対し、技術を持たないアホが画像生成AIを手にしてしまったということが数々の問題を引き起こしています。
アメリカでは大量のアホがフォトリアルなエロ画像を生成しているせいで出てくる問題なわけです
逆に言い換えれば、日本にも知人でLoRAする知人の写真で追加学習させるアホが探せばいるかもしれないけれど数が少なすぎて表面化しないということですね
念のためAI画像生成絵師さん達の名誉のために書いておきますが、Pixiv等でルールを守って投稿されている方々は何のトラブルも起こしていません。生成している絵もこだわりが込められていて、使う道具が違うだけで愛があるのだと感じます。まともな人ほど静かで目に入らない、問題のあるやつほど悪目立ちするというのが話がこじれる原因ですね
一連の記事は絵師とAI絵師の対立を煽るものではないことを強調しておきます。(いちおう私は絵師の立場です)

In a discussion about the case, someone raised an objection to "someone who was not a party to the incident, who was not from Nagasaki, and who was not from Hiroshima, complaining about it. Seeing that opinion made me aware of my position, so I will say what I must say.

I think it was even more painful for the elderly people who told the stories. But I don't think an elementary school kid could have imagined that. I, too, have forgotten most of the stories I was told. I can only remember one or two at most.
Another thing is that at this time of year, pictures of the victims of the atomic bombing are pasted up in the hallways.
In other parts of the country, these are grotesque images that would cause a fuss from the parents who are always nagging about them.

A young brother and sister found their father's corpse in the ruins of the fire and burned it themselves. They didn't have enough wood to burn him alive, and when they saw his brain spilling out, they ran away, and that was the last time they ever saw him again.
I can never forget that story I heard when I was a kid, and even now it's painful and painful, my hands are shaking and I'm crying.

I heard that many of the horrifying exhibits that used to traumatize visitors at the Atomic Bomb Museum have been removed, and the museum has been considerably sanitized. I'm not sure about the current situation, but that's how it was when I was there.
There was one photograph that I could never bear to look at as a child – a picture of Tadashi Taniguchi. You can find it if you search, but it's a shocking image with a viewer discretion warning. Still, I want people to see it.

Even though my grandpa was not a child, I'm sure there were elementary school kids who did similar things. I don't just think they might have been there; they were there. I heard the stories from the people themselves, and I still remember them.
I can't forget the stories I heard as a child, such as the young siblings finding their father's burnt corpse in the ruins and cremating him. They didn't have enough firewood, and their father ended up half-burnt. They ran away after seeing the brain tissue oozing out, and that became their final farewell.
I can never forget those stories I heard as a child, and even now, they still bring pain and suffering, making my hands tremble and tears flow.
I wonder how my grandpa, who ran away from that father's brain tissue, could expose his unimaginable trauma and everlasting scars to the world.

The unimaginable pain that existed 78 years ago has mostly disappeared, and we can no longer pass it on.

「言葉遣いや地元の慣習に馴染めなかった娘は学校でも浮いてしまったようで、毎日暗い顔をしていました。私立と言っても地方では結局地元の人間の集まりなんですよね。同じ小学校や同じ町内から通学しているようなコばかりで、遠方、それも東京からの編入生である娘は周りから距離を置かれていたようです。
本人は普通に振舞ってるつもりなのに『気取ってる』『セレブぶってる』とか言われて仲間外れにされたみたいですね。息子は息子で『でかくて変な成金趣味の家の子供」という目(偏見?)で見られていたようです。『成金趣味』だなんて、小学生が日常的に使う言葉じゃないと思うので親や周りのおとなの影響でしょう。
一番ショックだったのは先生方もよそよそしかったことです。授業参観に行った時、いくら手をあげても指してもらえない娘の姿や、休み時間に他の子供たちが先生に誘われて校庭で遊んでる中、ひとりで教室に残る息子の姿を目にした時は胸が押しつぶされそうになりました」
調べてみたらひどいクソ仕様だったので、同じ轍ふまないように知見共有します。
なお、消えてしまったデータは息子の卒業式の動画データ。復元不能。
ストレージは壊れるものという前提は理解しているつもりなので、状況ごとにいくつかのバックアップ体制は取ってある。
安くなったとは言えすべてのストレージをSSD化するには至っていない。
そのため、OSやソフトウェアなんかはSSDにインストール、写真や動画などのサイズがでかいデータはRaid HDDでミラーリングして格納するようにしている。
それ以外にもそれほどサイズの大きくないデータはonedriveとかのクラウドストレージを利用。そのデータもRaid HDDでミラーリングして二重にバックアップ体制を敷いている。
趣味で写真をやっているのだが、今回の事故はその編集のフローの中で起こった。
編集と格納は別で考えているので、アクセス速度が高いほうがいい編集はSSD上で行い、格納はRaid HDDに行っている。
そのタイミングでgoogle photoに分散バックアップ、必要に応じて家族なんかと共有を行う。
つまり、撮影が終わったら最初にすることは、SSD上にあるデスクトップの一時フォルダに写真と動画データをコピーすることから始まる。
Raid HDDに格納するのは、編集ソフトでレタッチが終わってからだ。
まずは写真データから編集を行い、RAWデータから無事にjpegデータへと書き出してHDDへの格納が終わった。
そのタイミングで妻からの頼まれごとのためにメールをpdfプリントして名前をつけて保存しようとした。
めったに使わない機能なのだが、指定されたのはonedriveフォルダだったので、そのまま保存をクリック。
ところが、PCからonedriveフォルダにアクセスしても出力したpdfデータが見つからない。
おかしいなと思ってもう一度出力を試みて保存フォルダのパスを確認してみる。
すると、今現在HDD側に指定してあるonedriveのパスが、SSD上のデフォルトのパスに指定されているようだった。
ここで思い至ったのが、確かPCにonedriveを設定した際にうっかりデフォルト設定のまま起動してしまい、その後、HDD上にパスを切り替えたという状況だった。
「そうかぁ。保存先を変更すると元のファイルを移動させるんじゃなくてコピーを作ってしまうんだな」なんて感じに妙に納得しつつ、もう一度しっかりとパスを確認した上でpdfをコピーしてからSSD上のonedriveをshift deleteで削除した。
エクスプローラーを閉じてデスクトップに戻ってくると妙な違和感。
ない。
はぁ?と思ってPCをダブルクリックすると、すぐに警告ウィンドウが開いて「デスクトップへのパスが間違っています」といったエラー表示。
焦る。かなり焦る。
ウィンドウをすべて閉じても、デスクトップ上にはデフォルトのアイコンだけが並んでいるだけ。
頭真っ白。
多少大事なデータはあったかなと思いながらも致命的と言えるものは思いつかず(まだ見落としてるだけかもしれない)、しかし、すぐに一時フォルダごと動画データがないことに気づく。
写真はすでにjpg出力してあるので、RAWデータが消えてしまったのはなんとかなる。
子供の卒業式の動画はまだ変換をかけてもないし、当然アップロードもしていない。
終わった。
あまりにもショックだ。
読み飛ばしここまで。
結局何が原因だったかというと、最初にonedriveをセットアップする際に、デフォルトの保存先、なおかつデスクトップやマイドキュメントなんかもバックアップに含めるという設定で始めてしまったからだったらしい。
この、onedriveのバックアップにデスクトップを含めるという操作をすると次のようなことが起こる。
「本来はC:\Users\ユーザー名\Desktopにあるはずのデスクトップデータが、C:\Users\ユーザー名\onedrive\Desktopに変更される」
・onedriveのバックアップからデスクトップを含めないように設定変更
この2つの動作を行ったにも関わらず、何故かこのパソコンのデスクトップは、C:\Users\ユーザー名\onedrive\Desktoに残ったままになってしまったというわけだ。
そのため、C:\Users\ユーザー名\Desktopにデスクトップがあると思いこんでいた自分は、C:\Users\ユーザー名\onedriveにあるonedriveのフォルダを、疑うことなく削除することができた。
そしてその結果、デスクトップにおいてあったデータのすべてを失った。
いや、流石にこんなクソ設定想定できないでしょ。
大事なデータを守るっていう名目があれば、大事なデータの格納先をそんな簡単に変えていいと思ってる?
それ、誰に許可取ってやってるんだよっていうさ。
その辺の共通プロトコルを、バックアップソフトが、しかもOSの提供元がやっていいのかよっていう。

どこに気持ちをぶつけたって息子の大事な思い出は帰ってこないのはわかってるけど、やるせなさくらい吐き出させて。
※追記
ブラウザonedriveのゴミ箱にデータが残っている可能性はゼロです。
その理由は以下の通り。
このパソコンは1ヶ月ほど前に新規にセットアップしたものでした。
そのセットアップの過程で、onedriveをインストールする際にデフォルトの保存先、なおかつデスクトップをバックアップという設定にしてしまいました。
ここでノールックで設定してしまった自分が一番悪いことは認めます。
onedriveのセットアップが終わったあと、同期に時間がかかっていておかしいな?と思ってファイルのアップロード履歴を確認したところ、あらかじめ古いパソコンからコピーしてあったデスクトップのデータをアップロードしようとしていたので、慌てて設定を見直して、デスクトップ同期のオフ、保存先をHDDに変更しました。(変更した順番は書いてある通り覚えていません。順番が逆だったら起こり得なかったかも)
この操作によって、onedriveの保存先はHDDに変更になり、デスクトップの同期も停止しました。
しかしそうした操作を行ったにも関わらず、デスクトップの保存先はC:\Users\ユーザー名\Desktopに戻ることはなく、C:\Users\ユーザー名\onedrive\Desktopのままになってしまっていました。
そのことに気づかずに1ヶ月以上作業を続けていたなかで、記載の通りSSD内に同期されていないonedriveフォルダを発見したので削除した結果、デスクトップのデータが消失しまったという話です。
そして卒業式の動画データをデスクトップにコピーしたのは、onedriveの同期を切ったずっとあとのことです。
もともとonedriveにバックアップするつもりもないし、バックアップされていないのでwebに残っているはずもないのです。
デスクトップのデータがそんなところに格納されていることがわかっていれば、もともと削除なんてしません。
同期されていないすでに使われていないonedriveのデータだけしか削除するつもりではなかったのに、何故かその中に現在進行系で使っているデスクトップのデータが格納されていて、一緒に削除されてしまったというお話です。
ちなみに、削除直後は本当に何が起こったのか意味がわかりませんでした。
その後にマイコンピューターを開いた際、別ウィンドウでエラーが出たことで初めて状況が理解できたということです。
そのエラーが「デスクトップC:\Users\ユーザー名\onedrive\Desktopにアクセスできません」といった内容のエラーです。
デスクトップ?お前なんでそんなとこに保存されてたの?からの、そういえば思い出してみればこんなことあったよなーで、原因に思い至ったというわけです。
SDカードの復元を試みましたが、サイズの大きい動画データですので、ヘッダーは読み込めたものの、データそのものはすでに別の写真データに書き換えられてしまっていたせいかちゃんと開けませんでした。
SDカードからデスクトップにデータを移すタイミングというのは、行事ごとに撮影が終わったらSDを空にして新しく撮影できる状況を作るためなので、基本的にはデスクトップにコピーしたあとは次の撮影前に必ずフォーマットすることを習慣づけています。
それは、毎回SDカードを空っぽにすることで、現像のときにデータの重複が起こらないようにするためです。(趣味で写真を取っているので撮影枚数が莫大。尚且つ現像ソフトで不要データを削除するので、SDを空にしないと、削除後にまたコピーしてしまったりと効率が悪いため)
撮影→データをデスクトップに一次保存→次回撮影時にSDカードのフォーマット→時間があるときにPC上のデータを選別、現像→バックアップ含めてデータを格納→SDカードから新しい撮影データをPCにコピー→次回撮影時にフォーマット→時間あるときにPC上のデータを選別、現像→・・・・
SDカード自体も紛失の危険性とか考えてそれほど信用しているメディアではないので、できるだけデータが保管されている時間を短くするようにしています。
個人的には、このワークフローが一番データの保存性も高く、無駄も少ない処理方法だと思っています。
だって、デスクトップを間違って消すなんてこと普通しないでしょ。
壊れたなら仕方ないって、それはそれで納得できるんだって。
流石にこんなことまで想定したワークフロー作れってのは無理な話ですよ。
すでにonedriveからデスクトップの同期も切ってて、しかも別フォルダでonedriveがちゃんと稼働してるのに、まさか自分のデスクトップがC:\Users\ユーザー名\onedrive\Desktopに保存されてるなんて思う?

以草津溫泉聞名的群馬縣草津町,昨日(6)地方町議員罷免公投結果出爐,草津町有史以來第一位女性議員確定遭罷免。
隨著這場已經為期一年的地方議員攻防戰又再一次劃下一個逗點,草津溫泉曝光率大增。有不少網友表示再也不想去草津溫泉觀光,表明再也不去草津溫泉的hashtag #草津温泉には行かない 在 7號上午一度衝上日本推特流行趨勢,更有媒體形容現在的草津溫泉根本就是「厭女之湯」。
2011年,出身於群馬縣桐生市的新井祥子當選草津町議會的議員。新井祥子是草津町議會有史以來首位女性議員,更連任過一次。
去年(2019)11月,新井祥子出版電子書籍,並在書中表示是自己曾在町長室裡和町長黑岩信忠發生性關係。新井祥子在 11月29日的記者會上表示,自己在 2015年1月8日前往町長室時遭到町長強暴。新井祥子說,今天她之所以會把這件事情寫在電子書裡,是因為草津町的警察和媒體都在町長的掌握之下,所以她才選擇用這種方式將這件事情公諸於世,並強調自己所寫的內容都是真的,之後在法庭上一定能證明這些內容都真的。
這裡所說的法庭,指的是黑岩信忠町長吿新井祥子損害名譽的民事訴訟,目前訴訟還在進行中。
不信任案提案失敗,提案議員遭懲處
就在新井祥子召開記者會後過了幾天,新井祥子和另一名草津町議員中澤康治在 12月2日向黑岩信忠町長提出不信任案。但該不信任案只有提案的 2人贊成,其餘 9名議員都反對,該不信任案遭到否決。同一天,草津町議會以「傷害到議會的品格」為由,在只有 12人的草津町議會以超過 4分之3門檻的 10票同意票,在 12月2日將新井祥子從議會中除名。至於和新井祥子一起向町長提出不信任案的中澤康治,則在 12月6日的町議會上遭到「陳謝處分」——中澤康治被迫要在議會上為自己說了「不符合事實」的發言道歉。
對於除名處份不服的新井祥子,向群馬縣知事山本一太申請審查。群馬縣先在 12月10日做出假處分,要求草津町在群馬縣審查結果出爐之前,必須要立刻恢復新井祥子的席次,否則會侵害到新井祥子支持者的參政權。群馬縣接著在今年 8月,群馬縣正式取消新井祥子的除名處分,讓新井祥子恢復草津町議員身份。
縣政府才剛取消處份,町議會就發起連署
然而,這起事件並沒有因此結束。在群馬縣取消新井祥子的除名處分後,草津町議會議長黑岩卓連同其他町議員立刻組成「要求新井祥子解職之會」,表明草津町議員不能接受群馬縣取消了新井祥子除名處分的決定,要求草津町民們一起來罷免新井祥子。罷免理由是,不能接受新井祥子在議會上說自己和町長在町長室發生肉體關係,這已經重創草津溫泉的品牌形象,不應該再繼續支付新井祥子議員薪資。
這起罷免案在今年 9月初達到罷免門檻,以草津町議會議長黑岩卓為首的罷免案獲得超過選舉人名簿 3分之1以上的 3,180人連署。將在 12月6日正式舉行罷免公投。
罷免公投通過,新井祥子即刻遭解職
罷免公投開票結果, 2,542票贊成、208票反對,贊成票超過有效票半數以上,新井祥子即刻遭解職。投票率 53.66%(投票權人共 5,283人)。
值得注意的是,罷免案的連署共有 3,317人連署(有效連署書只有 3,180份),但實際出來投票的人只有 2,750人。也就是說,有不少民眾有連署罷免,但卻沒有真的出來投票。這次罷免案的投票率雖然有 53.66%,但相較於去年 4月草津町議員選舉的投票率高達 69.49%,這次的投票率不算高。
根據草津町選舉管理委員會,12席的町議會在 11月26日時有一名議員過世,再加上這次新井祥子遭罷免,目前草津町議會只有 10席議員缺 2席。如果又少 1席次的話,才會舉辦町議員補選。
訴諸情感缺乏理性判斷的罷免案
面對這次的罷免案結果,新井祥子表示這樣由町議員主導的罷免公投是否真的反映民意感到質疑,不排除申請異議。新井祥子也提到,她認為像町長和町議會這樣以自己在地方的勢力要求町民配合的公投案,才是重創草津町、草津溫泉品牌的因素。
擅長地方自治論的高崎經濟大學岩崎忠也質疑,這次針對新井祥子的罷免案是以「品格」、「倫理」為訴求,認為新井祥子沒有續任町議員的「品格」。但有沒有符合町議員的「品格」這種事情很難用「贊成」和「反對」來判斷,到頭來這樣的公投只會陷入情感論,感情用事,而非理性的投票。
以男性為首的「村社會」
網路媒體《HARBOR BUSINESS》就指出,這次罷免案最大的問題在於,新井祥子和町長黑岩信忠的性侵案還在調查與訴訟進行階段,在這種情況下,由議會長主導公投罷免案,現在將新井祥子罷免掉了,萬一之後訴訟結果,真的認定町長黑岩信忠性侵新井祥子,該怎麼辦?
再者,地方公投這種事情是訴諸民意沒有錯,但官方應該要確保中立的立場,才能將民眾可以公正客觀的判斷。但這次的情況是,町議會在草津町各大公共空間都貼滿了「罷免新井議員!」的海報,相當於讓所有來到草津溫泉觀光的民眾,來到草津溫泉第一眼看到的不是「歡迎光臨草津溫泉」而是「恢復草津溫泉的驕傲與信賴,罷免新井議員!」,在公共空間只能看到官方強制推行的單一立場,沒有辦法看到另一派聲音,這樣就已經失去了公投的公平性。
此外,面對新井祥子這樣說出自己被性侵經驗的受害者,町議會沒有保護當事人就算了,還這樣大大方方地在草津溫泉的公共空間裡貼滿了「罷免新井議員!」的海報,根本就是在和社會大眾說草津溫泉就是個「厭女之湯」。《HARBOR BUSINESS》總結到,這次一連串的事件就是以町為單位的霸凌事件,也讓大家再次看到鄉下地方封閉的「村社會」壓力與以男性為首的厭女風氣。

フルハイビジョンでも4Kでもファミリー向けビデオカメラの画質はクソい。
でも、デジイチやミラーレスの動画と比べると、CMOSサイズの影響で明らかに劣る。
デジイチのニコンD3400のフルHDと4KハンディカムのソニーAX60を比べたら前者のが圧倒的に綺麗なのよ。(しかもD3400はエントリーモデルで、旧世代のD5000あたりは中古で2万円程度。AX60は新品9万もする。)

「SHEIN」については大量高速企画ゆえのデザイン盗用疑惑、小ロット高速生産ゆえの労働環境疑惑が指摘されているが、私は次の二点で容認すべきでないビジネスだと考える。
一つはH&Mなど従来のファストファッションなどとも共通する「使い捨て」懸念であり、手早く安価に作られた「SHEIN」の商品が長く愛顧されてリユースされていくとは到底思えない。
物性的にも感性的にも耐久性は期待できないから、短期に捨てられて大量の衣類ゴミとなっていく運命が見えている。それが地球環境の負荷となるのは言うまでもなく、アンチ・サステナブルとの誹りは免れない。
二つ目は関税も消費税も負担しないアンフェアなビジネスだということだ。
初期のアマゾンでも消費税と法人税が回避されているという指摘があったが、越境D2C(消費者直販)の「SHEIN」は日本国の法人税はもちろん、関税も消費税も回避している。
それゆえ安価で消費者を捉えているが、競争条件の不利な国内アパレル販売を圧迫しているし、国富が中国資本に流出していると言う事実に目を瞑るべきではない。
