デペロッパーツールだけで動くだけでいいなら、3行目のArray.fromがなくても動く。多分、forEachをmapに書き換えても動く。個人的にはforEachに統一したいけど、そこは好みレベルの問題だと思う。

これはid:muchonovによる、id:rag_enさんのエントリ muchonovさんの提示した「判断力が未熟だから」論法では、年齢による“パターナリズム”を肯定するのは無理があるよという話と、あとリテラシー - Click Game. への返信です。
まず、rag_enさんがご引用くださっている、自分が増田で書いた文章「子供の権利は制限されているし、性行為に伴うリスクを判断できない」の位置づけなんですが、これはmuchonovが何か新しい提案をしたぞとか、今からそういう社会を作るぞ、という内容ではありません。このスレッドの親増田の「なぜ、子供が性を売ってはいけないのか」という疑問への応答として、今の社会がそういう風になっている理由として、法律的・社会的にこのような背景がありますよ、と説明するものです。言い換えると、これは〈べき論〉ではなく〈である論〉のつもりで書いたものです。このことは、ここから先の話とも繋がってますので、ひとまずスタート地点としてご認識ください。
rag_enさんは以下のように、「『社会的コンセンサスがあるから』という理由でのパターナリズムの肯定」や（判断力が未熟な当事者を保護する）「手段としてのパターナリズム」自体を強く批判されています。
未成年に対しては愚行権を含む自由権に一定の制約を課すべきだという社会的コンセンサスがあるからです。未成年に対しては人権を制約するレベルのパターナリズム（保護者的統制主義、当事者の能力やリソースの不足を社会が保護者として補い、庇護する）をとってもよいし、分野・状況によっては積極的にそうしなければいけない
いやもうこれ、『社会的コンセンサスがあるから』なんていう、ふにゃふにゃな理由での“パターナリズム”を肯定してしまっているの、控えめに言っても完全に思考が狂ってますよね。
そもそも『「判断力」によって峻別すべき』だと仰るならば、「ペーパーテストして免許制にでもすれば？」でほぼほぼ終了する話なわけです。『「判断力」によって峻別すべき』ならば、その「判断力」をテストする、というのはどう見ても最も正道な手段なのですから。“パターナリズム”などという手段を用いる必要は全くありません。
ここを読んでいて、最初「ん？」と混乱してしまったのですが、もしかしてrag_enさんには、「パターナリズム」という概念について重大な誤認がありませんか。rag_enさんが「“パターナリズム”などという手段を用いる必要は全くありません」という主張とともに、代案として展開されている「判断力によって（ある問題についての当事者能力や責任能力の有無を）峻別する」、そして、判断力がないとみなした対象の自由権を（当人の保護のために）何らかの形で制限する…という考え方は、まさに『パターナリズム』そのものではないですか？
現行の日本の法律が、年齢によってその人物の判断能力を推認し、それが十分でないとされた年齢に属する児童を保護するために彼らの自由権を一部制約するのも、別の方法で判断能力を吟味・裁定し（たとえば精神的な障害を持つ人や依存症に苦しむ人や認知症患者などを、家裁の判断によって成年被後見人とすることなど）、彼らを保護するために彼らの自由権を一部制約するのも、どちらも法学の分野でいう「弱いパターナリズム」だと思います。
憲法学の世界で「パターナリズム」といえば、まず未成年者の人権制約の場面が思い浮かぶ。すなわち、十分な判断能力のない未成年者については、親が子に干渉するようなやり方で、国が未成年者の人権を制約することが認められると考えるアプローチである（１）。たとえば佐藤幸治は、未成年者の人権制約について、未成年者が「成熟した判断を欠く行動の結果、長期的にみて未成年者自身の目的達成諸能力を重大かつ永続的に弱化せしめる見込みのある場合に限って正当化される」とし、これを限定されたパターナリスティックな制約としている（２）。このようなパターナリズムは、個人の判断能力の不十分さを補うために後見的措置を行うことから、弱いパターナリズムと呼ばれる（３）。
そして、未成年や年齢が低い児童の判断能力が不十分とみなされる理由は、法学の世界では、彼らの判断が、それ以上の年齢層による判断に比べ、①知識や情報を得た上での判断・②適切な理解に基づく判断・③強要なき自律的判断・④実質上も自発的な判断ではない可能性が高く、それによって、当事者自身が想定しない結果や不利益をもたらすリスクが懸念されているからです。[^1]
[^1]性的自己決定に関しては、古い調査ですが、10代の人工妊娠中絶についてのアンケート結果（https://www.jaog.or.jp/sep2012/JAPANESE/MEMBERS/TANPA/H15/030217.htm）を読む限り、確かにそのリスクは存在しているといえます。10代の妊娠中絶経験者の68.1%は妊娠して「困った」と回答しており、その多くが①②膣外射精や安全日など誤った避妊方法を選んだり（情報や理解力の不足した判断）、③相手が避妊をしなかったり（強要された判断）、④経済的事情などを踏まえれば出産・育児は不可能なのに妊娠する可能性のある行為をしてしまう（実質的には非自発的な判断）など、当人の判断能力の不足によって、望まない妊娠と人工妊娠中絶に到っています。
この前提において、当事者の自由権を法と社会が一部制約することが正当化されています。これはmuchonovが勝手に言ってることじゃなくて、法学におけるパターナリズムの議論の中で整理されている話です。
「ソフト（弱い）パターナリズム」が自由への介入を正当化できるのは、人の行為が以下の何れかに因って判断された場合です。
１． 実際に情報を知らされないで判断した場合（not factually informed）、
２． 適切に理解していないで判断した場合（not adequately understood）、
４． その他、実質的に自主的にではなく判断した場合（oterwise not substantially voluntary）。

そして、未成年者や特定年齢に満たない児童に対する「弱いパターナリズム」に基づく人権制約は、日本を含め、大半の近代国家の法制度に含まれています。性交同意年齢という概念もそうですし、制限行為能力者という概念もそうですし、ある面では責任無能力者という概念もそれに関わっています。そのような、未成年者や児童の人権を明らかに制約する仕組みが各国の法制度に組み込まれているのは、当然、その国家が議会立法などの民主主義的手続きを経てその法律を定めた結果であり、『社会的コンセンサス』の賜物でしょう。
だから先ほどのrag_enさんの、「『社会的コンセンサスがあるから』なんていう、ふにゃふにゃな理由での“パターナリズム”を肯定してしまっているの、控えめに言っても完全に思考が狂ってますよね」とか、「muchonovさんの提示した「判断力が未熟だから」論法では、年齢による“パターナリズム”を肯定するのは無理がある」という指摘は、日本だけでなく、性交同意年齢や制限行為能力などの概念を法制度に組み込んでいる全ての国家や社会に対して「完全に思考が狂ってますよね」「論法に無理がある」と非難していることになりませんか。
現在の日本では、性交同意年齢（13歳）未満の男女と「性交等」をすることは法律で禁じられており、もしそうした場合、それが13歳未満の側の当事者の主体的判断によるものであっても、相手は強制性交等罪（非親告罪）で処罰されます。13歳未満の側の当事者には、必ずしも性交に関して正しく判断する能力が備わっておらず、その能力の不足による誤った判断の不利益から彼らを保護しなければならない、とみなされているからです。これも「完全に思考が狂っている」「無理がある」論法でしょうか。
私はrag_enさんがそういうチャレンジングな主張を展開されるのは別に構わないと思っていますし、繰り返しそう申し上げてもいますが、だったらその主張はmuchonovという個人に向けて言うべきことじゃなくて、そうした法制度を運用している国家やそれを是認している国民に対して言うべきことなんじゃないかな、と思います。だから自分は、再三「rag_enさんのお考えを、広く世間に問えばいいと思います」と申し上げているんですけども。
あと、これはこちらの邪推ですけど、おそらくここでrag_enさんが問うべきだったのは、「性的自己決定権をめぐるパターナリズム的な人権制約の適用対象を決める上で、年齢という指標を用いて一律に決める（現在の法制度に組み込まれている）方法と、ペーパーテストを行って免許を付与するという（rag_enさんが提唱する）方法の、どちらが制度設計として筋がよいか」ということだったのではないでしょうか。そうではなく「パターナリズムという手段ではなく、ペーパーテストと免許制という手段を使えばいい」と主張されている姿勢から、rag_enさんのパターナリズムについての認識は、一般的用法とズレがあるように感じました。もし「そうではない」ということなら、そうおっしゃってください。
※ここでもし自分がrag_enさんを先回りして擁護するとしたら、「rag_enさんの言うペーパーテスト＋免許制という提案は、パターナリズム的な観点（判断力が未熟な当事者を保護するため）に基づくものではなく、その行為による他者危害のリスクなどを鑑みて、本来は無許可では行ってはいけない諸行為に対し、当事者の能力・知識・技術を総合的に認証したうえで特別にアクセス権を付与するもの、つまり自動車免許や医師免許に相当するものであるから、パターナリズムにはあたらない」という立場は、かろうじて取りうると思います。未成年や児童が関わる性行為について、当事者の不利益よりも他者危害のリスクを先に考慮しなければいけない状況というのは自分には俄には思いつきませんが、まあそこはよしとしましょう。
しかし、そのような制度---国家が国民の性行為に関わる知識や判断能力をペーパーテストで弁別し、それが当局の定めた水準を満たしているかどうかによって、セックスの権利を与えたり奪ったりする制度---というのは、自分は国家による生-権力的介入・管理のアプローチとしていささか度が過ぎていると思います。というか、「規律化による〈従順な身体〉の構築」というフーコー的テーゼをそのまま戯画的に具現化したような感じすらします。
また、自動車免許の社会実装コストについてのrag_enさんの記述を踏まえると、rag_enさんは、その「セックス免許」の仕組みを社会実装するコストも、免許取得費用として「受験者」から徴収して賄えばいい、とお考えのように見えます。セックスへのアクセス権を求める市民自身から試験料を徴収して、セックス免許センターで受験者にテストを行って、合格者に免許を発行する。もしそういう制度運用をイメージされて仰っているのなら、この構想が現行の法制度にある「年齢によるパターナリズム的保護」の仕組みよりもメリットが多くデメリットが少ない現実的な提案だと感じる方は、あんまりいないんじゃないでしょうか。もちろん、rag_enさんのような考え方の人たちが社会運動などを通してそのアイディアを人々に受け入れさせて、社会的コンセンサスを変えていくことができれば、その状況も変化する可能性はあると思いますが。
